    I heard on the radio that she doesn't think the 2A is a fundamental right. Doesn't surprise me, but anyone else here that?

    I did find this though-

    Earlier this year, President Obama's Supreme Court nominee joined an opinion with the 2nd Circuit Court of Appeals ruling that Second Amendment rights do not apply to the states.

    A 2004 opinion she joined also cited as precedent that "the right to possess a gun is clearly not a fundamental right."

    I see the 2A as a national, you can't bend/ twist/ distort/ etc, fundamental right to any law abiding citizen.

    I do not think a State or otherwise jurisdiction (ie DC) has the authority whatsoever to restrict, in any way, shape, or form, the very definition of the 2A, or you'll get liberal-heavy states (like NY or NJ) making their own definition of what 'right to keep and bear arms' means. This is one of the very aspects of the BoR that a State can't trump, hence the reason for the 10A (actually a State can't trump any Amendment and neither can Congress! ...but we all know they do any way).

    As I have said before, I believe a law-abiding citizen can own whatever firepower the US Gov't owns (minus nukes because of biological hazards and safegaurds). That was one of the very principles in which Madison framed the 2A, to protect against a tyrannous gov't.

    She is an empty suit, but that is what the libs like about her...

    PAT BUCHANAN: Well, I think I would vote no on Sonia Sotomayor the same way I would have voted no on Harriet Miers-and I said so the first day she was nominated.
    I don't think Judge Sonia Sotomayor is qualified for the United States Supreme Court. She has not shown any great intellect here or any great depth of knowledge of the Constitution. She's never written anything that I've read in terms of a law review article or major book or something like that on the law.
    And I do believe she's an affirmative action appointment by the president of the United States. He eliminated everyone but four women and then he picked the Hispanic. I think this is an affirmative action appointment and I would vote no.
